Use of personal data

Unless otherwise agreed in writing, a registration at RSVD shall define the end consumer as having a business relationship with RSVD and by extension, RSVD’s Licensee’s too, for the purposes of an end consumer permitting marketing communications from RSVD and/or Licensee. A customer relationship shall be created because, through registration, the consumer is agreeing to be contacted by RSVD on behalf of its Licensee to facilitate a reservation in exchange for providing their contact information including mobile phone and email or authorizing a credit card reservation fee or credit card hold. Even if no money is paid by the end consumer to RSVD, a consumer business relationship exists as the consumer has the permission to utilize the RSVD Software and make a reservation by registering, if such RSVD reservation service is paid for by RSVD and/or RSVD’s Licensee. In some cases, the Licensee or a third party brand through the Licensee or RSVD, may provide the RSVD Software as a benefit to the RSVD end consumer, which is also deemed to be a business relationship with the consumer. A registered user of RSVD’s system shall automatically mean they agree to opt-in and consent to receive mobile text messaging, email communications and mobile or telephone contact by RSVD and/or by its Licensees. RSVD’s Terms of Service and/or Privacy Policy grant registered RSVD and/or its Licensee, permission to remarket to registered RSVD users (and/or remarketing by Licensee directly using RSVD registrant data obtained by RSVD on Company’s Licensed Account.) RSVD agrees to comply with mobile and email marketing industry standards for RSVD initiated mobile or email marketing and communications only. To the extent, Licensee uses imported RSVD registrant consumer data to conduct their own marketing, in their own systems or licensed systems which are sent by Licensee independent of RSVD’s Software, RSVD is not responsible or liable for mobile and email marketing opt-in, opt-out management, or related legal and financial compliance, nor fees or penalties if such legal and best practices are not followed. RSVD highly recommends Licensee obtain their own direct opt-in and opt-out permissions within their own opt-in mobile, email or U.S. mail marketing database(s) when marketing to any end consumer whose profile information was obtained from RSVD.

Content (text, images, video, logos, trademarks, brand or consumer data), hereafter “Content,” provided by Licensee to RSVD, or developed by RSVD and approved by Licensee, when utilized by RSVD, shall be deemed to carry no liability for RSVD for its use and Licensee agrees to fully indemnify RSVD from any claim, suit or judgment for the use of such Content. RSVD does not currently sell personal data that we collect, process and/or store. If we wish to sell personal data in the future, we will ask for the user’s consent if and when that happens. We require that our client partners abide by RSVD’s Privacy Policy, Terms of Use and when applicable for certain users, the California Consumer Privacy Act as well as to agree to be a licensee of RSVD’s software and therefore bound by the terms of the license. A licensee is not permitted to utilize consumer data obtained from RSVD’s Software to sell such data to third parties without specific separate consent between Company and the RSVD end-consumer. Any such opt-in and opt-out of consumer data for the purposes of sale to third parties, its use and privacy is the sole and exclusive responsibility and liability of the Company to obtain from the consumer and must take place in Licensee’s own secure, consumer data privacy database.

RSVD does not currently transfer data that we collect to third parties other than in response to a request from a data subject that we provide data in a machine-readable format and send it to another data controller. This is called “data portability”. RSVD reserves the right to provide API connectivity to a licensee’s own website, mobile application or internal or licensed consumer marketing and contact database system / customer relationship management (CRM) system.

By registering and using RSVD’s software and systems, you understand and agree that RSVD may make information regarding your registration, reservations, service selection(s), attendance and data voluntarily supplied by you in RSVD’s software and systems to our licensed clients, and by extension their employees which are subject to RSVD’s license and Privacy policies, to determine the activity and efficacy of RSVD’s software and systems.

RSVD may also provide anonymous, aggregated data and trends to licensed clients and prospective clients of RSVD to discuss how groups of users, events or multiple events or certain types of industries and how line types perform, etc. as part of our client reporting and/or RSVD marketing efforts. No identifiable, personal data will be shared publicly by RSVd, unless you authorize us to do so for instances such as, but not limited to, user approved case studies, client case studies that cite your personal information, user profile information, user event or attendance information, transaction information with RSVD and/or licensee’s business, RSVD marketing materials, consumer profiles or press releases.

Personal data storage

We store and use your personal data for both short-term and long-term purposes. Short-term, we store your data to enable us to provide our services to our partners, i.e., allowing them to offer and utilize line management for their own benefit, and for the benefit of those to whom they provide goods and services. Long-term, we store your data for marketing purposes as we continue to promote our services to new individuals and various types of organizations and businesses. As mentioned above, we use your personal data both short-term and long-term to help our partners understand the scope of how using RSVD for line management benefits them and those for whom they provide goods and services compared to the use of actual queues.

RSVD may lease or sell computer hardware such as Apple or Android or other mobile and WiFI enabled tablets or other portable, mobile devices to help clients offer an easy way for those who visit our clients in their place of business, store, location or event in person to register for RSVD or make one or more reservations. Licensees of RSVD may als provide their own computer hardware for similar RSVD purposes and or non-RSVD purposes unique to their own business, such as but not limited to promoting their own website, offers, marketing opt-ins and ecommerce activities. RSVD is not responsible for any data you may store or enter on a RSVD provided device, nor any device an active, inactive, suspended or past licensee utilizes. RSVD’s Privacy Policy is only governed by end user data which is directly provided by user voluntarily into RSVD’s software and systems.

Your personal data may be identified or may be identifiable to RSVD and our client partner for which you registered, which by extension, user is deemed to be a customer of both RSVD and RSVD’s licensee for which you registered, even if no sale or transaction took place except registration. As such, a licensee may export and import your RSVD registration data and store that information in their own marketing and business systems for their own use, independent of RSVD software and services. A registered user of RSVD permits the direct marketing and use of registration and event data by RSVD and the licensed client partner(s) for which it used RSVD’s software and systems.

Personal data retention

To serve our partners with both short-term and long-term uses of data, we retain personal data indefinitely and do not purge it periodically. This allows us to compare information, such as no-show rates, satisfaction rates, times of high, low and medium customer volume, punctuality, etc. over time where desired.

In these cases, we use third-party services for credit card, debit card and other forms of payment processing (e.g. payment processors). We will not store or collect your payment account or card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy.
